Judgment
Surinder Singh, J.—In FIR No. 179 of 2008, registered u/s 379 of the Indian Penal Code, in Police Station, Theog, the Petitioner has been declared as Proclaimed Offender and the proceedings u/s 299 of the Code of Criminal Procedure are pending. The case is fixed for 22nd April, 2010.
The Petitioner is present today and prays to grant him bail.
There is an allegation against the Petitioner that he committed the theft of some shuttering Plates and removed it in his truck No. HP-33B-0282.
In view of the above, instant application is allowed and the Petitioner is enlarged on bail on his furnishing the bail bonds in the sum of Rs. 10,000/- with one surety in the like amount to the satisfaction of the Additional Registrar (Judicial) of this Court within two days with the direction that that he shall present in the Court of learned Judicial Magistrate 1st Class, Theog on 29th March, 2010, to enable him to move a regular application for seeking bail. The learned trial Court shall decide the same on merits in accordance with law. It is made clear that the Petitioner shall not tamper with the prosecution evidence in any manner and shall comply with the aforesaid directions in its letter and spirit.
The application stands disposed of.
