Judgment

The petitioner seeks quashing of the FIR No.119 of 2023, dated 05.05.2023, under Section 406 IPC, Police Station Mukhani, Haldwani, District Nainital, on the basis of amicable settlement between the parties. A joint compounding application has been filed along with the affidavits.
Heard learned counsel for the parties and perused the record.
According to the FIR, the petitioner has taken the vehicle of the informant, who is the respondent no.4, in lieu of some loan amount that is payable by the informant to the petitioner.
Learned counsel for the parties would submit that parties have amicably settled the dispute.
The petitioner as well as the respondent no.4, the informant, joined the proceedings through video conferencing. They are identified by their respective counsel. They have accepted the compromise.
Having considered all the attending factors, this Court is of the view that it is a case, which may be decided on the basis of amicable settlement between the parties. Accordingly, the petition deserves to be allowed.
The petition is allowed. The FIR No.119 of 2023, dated 05.05.2023, under Section 406 IPC, Police Station Mukhani, Haldwani, District Nainital, is hereby quashed.
Compounding Application No. 01 of 2023 stands disposed of, accordingly.
Let a certified copy of this order be supplied to learned counsel for the parties, today itself, on payment of usual charges.
