This matter is taken up by video conferencing mode.

This application under Section 389 Cr.P.C. is for bail upon appeal of the appellant Ranjan Kumar Behera who has been convicted for the offence

under Sections 376(2)(n)/506 of I.P.C. and Section 6 of the POCSO Act and sentenced to undergo R.I. for ten years and to pay a fine of Rs.1 lakh,

I.D. to further undergo R.I. for one year for the offence under Section 6 of POCSO Act and to undergo R.I. for one year and to pay a fine of

Rs.10,000/-, I.D. to undergo further R.I. for three months for the offence under Section 506 of I.P.C. by the learned Additional Sessions Judge-cum-

Special Judge, Boudh in his judgment dated 6th February, 2020 passed in Special Case No.25 of 2013 (POCSO Act).

It is submitted that the appellant was on bail in course of trial and has not misused the liberty granted to him.

After hearing learned State counsel and considering the statement of the victim made in her deposition as P.W.1, it is directed to release the

appellant on bail pending appeal in Special Case No.25 of 2013 (POCSO Act), arising out of G.R. Case No.87 of 2013 corresponding to Harabhanga

P.S. Case No.20 of 2013 on such terms and conditions to be fixed by the learned Additional Sessions Judge-cum-Special, Judge, Boudh.

The I.A. is accordingly disposed of.

available in the High Court’s website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide
