Judgment
Prayer in this petition filed under Section 482 Cr.P.C. is for
quashing and setting aside of order dated 25.10.2013 (Annexure P-8) passed
by learned sub-Divisional Judicial Magistrate, Patti, vide which the petitioner
was declared as proclaimed offender in case bearing FIR No.91 dated
08.05.2013 under Sections 302, 307, 148 and 149 IPC as well as Sections 25
and 27 of the Arms Act, 1959 registered at Police Station Patti, District Tarn
Taran (Annexure P-1).
Learned State counsel has produced the copy of warrant of
commitment of sentence of imprisonment issued by learned Additional
Sessions Judge, Tarn Taran and addressed to the Superintendent, Central Jail,
Amritsar, whereby the petitioner was sent to jail for having been convicted
and sentenced under Sections 302 / 149 and 148 IPC as well as Sections 25 and
27 of the Arms Act, 1959 in the FIR in question. The same is taken on record.
In view of the fact that the petitioner has already been convicted
and sentenced by learned trial Court in the FIR in question, the present
petition is rendered infructuous and is dismissed as such.
