Judgment

Heard Ms. P. Chettri, learned counsel for the petitioner, who has submitted that the petitioner has approached this Court with a prayer for grant of bail on behalf of his brother, Shri. Ferdinand M. Marak, who is an accused, who was arrested in connection with this case, though, in the FIR as well as in the charge sheet, the accused name has not appeared, that is to say that he is not connected with the case at all.
However, in due course, a Bailable Warrant of Arrest was issued against the accused person in question, and on 12.03.2026, he had appeared before the Trial Court. Surprisingly, the Trial Court, in its order dated 12.03.2026 in the related case, has remanded the accused person in question to 14(fourteen) days judicial custody. This according to the learned counsel, is beyond the jurisdiction of the said Trial Court, since no opportunity was given to the accused person in question to execute any bond or to produce a bailor for that matter.
At this juncture, Mr. R. Gurung, learned GA appearing for the State respondent has prayed for time to seek instructions.
Accordingly, as prayed for, list this matter for further hearing tomorrow i.e. 20.03.2026.
