1.This writ petition has been filed by Ran Singh Ghunta, challenging the action of respondents No. 3 & 6, shifting the Retail Price Shop owned by Smt. Uma Jhagta from village Sheekiar to the premises of Smt. Pushpa Sharma, situated at New Bus Stand, Nerwa.
The petitioner has approached this Court, alleging that he being a beneficiary of the Retail Fair Price Shop, would be adversely affected by shifting the said shop from the earlier location to the new location, which is about 2 kilometer away from the place of its earlier location. A reference is made to representations dated 02.07.2020 (Annexure P-5), made by one Sh. Onkar Chand and Sh. Rohit Kumar to the Sub Divisional Officer Chopal, District Shimla, whereby they have offered their shops, one in the size of 9x18 ft. and another in the size of 10x20 ft., situated in their premises for running the Retail Fair Price Shop. He prays that the respondents may be directed to shift back the Retail Fair Price Shop from Bus Stand Nerwa to Village Sheekiar, which caters the need of more than 1400 ration card holders of three Gram Panchayats.
Respondents No. 1, 3 & 6 have opposed the writ petition and submitted that in the new premises, the Retail Fair Price Shop would be more convenient not only for people of Gram Panchayat Nerwa, but also for the residents of nearby Gram Panchayats like Pujarli and Ruslah, therefore, the same has been shifted from Village Sheekiar to New Bus Stand, Nerwa to cater the need of the local residents. It is contended that pursuant to Resolutions of Gram Panchayat Pujarli, dated 5th July, .2020 and of Gram Panchayat Nerwa, dated 11th July, 2020, the decision of shifting the Retail Fair Price Shop from the premises owned by Smt. Uma Jhagta at Village Sheekiar to the premises of Smt. Pushpa Sharma, situated at New Bus Stand, Nerwa was taken, as Smt. Uma Jhagta, had made a request in her letter dated 15.10.2019 to the Managing Director, Himachal Pradesh State Civil Supplies Corporation, Shimla, for vacating the shop for her bonafide requirement, wherein she had mentioned that she had let out the shop in the year 2009 and her son is unemployed, therefore, she wants to get her premises vacated for the business of her son.
At which place, a Retail Fair Price Shop should be located, is essentially an administrative decision. We are not inclined to go into the controversy for the reason particularly when old landlady had requested for getting her shop vacated and the two Gram Panchayats by their Resolutions have requested for shifting the shop to a more convenient place, which would cater the need of the local residents of Gram Panchayat Nerwa and other nearby Gram Panchayats.
Accordingly, the writ petition is dismissed being devoid of merits.
The pending application(s), if any, also stands disposed of.
