Judgment
MINI PUSHKARNA, J (ORAL):
The present petition has been filed alleging deliberate and wilful disobedience of the directions as contained in the order dated 24th November, 2022, passed by this Court in W.P.(C) 13738/2022, titled as Ramveer Singh Bhati Versus Municipal Corporation of Delhi & Ors.
By way of the aforesaid order dated 24th November, 2022, the following directions had been issued:
The present contempt petition has been filed on the premise that despite categorical directions passed by this Court, requisite action has not been taken by the Municipal Corporation of Delhi (“MCD”), with respect to the unauthorized construction existing in the subject property of the present matter, i.e., Property No. B-52, Gali No. 1, West Vinod Nagar, Delhi.
This Court notes that earlier a Status Report dated 03rd February, 2025, on behalf of the MCD had been filed, wherein, it has been stated as follows:
Today, a further Status Report dated 20th July, 2026 on behalf of the MCD, has been handed over to this Court, which is taken on record.
The photographs have been attached with the said Status Report to showcase that the first floor of the subject property has been fully demolished by the MCD.
Learned counsel appearing for the respondent-MCD submits that further action shall be taken on the unauthorized construction, which is existing on the ground floor of the subject property.
The aforesaid statement made on behalf of learned counsel appearing for the respondent-MCD is taken on record, and the MCD is held bound by the same.
Accordingly, it is directed that the requisite action shall be taken by the MCD against the unauthorized construction existing on the ground floor of the subject property, expeditiously, preferably, within a period of four weeks, from today.
Needless to state, in case, the petitioner is aggrieved by any non-action on the part of the MCD, the petitioner is at liberty to revive the present petition.
Noting the aforesaid, the present petition, along with the pending applications, is accordingly disposed of.
