This criminal appeal assails the judgment dated 08.02.2008 passed in Special S.T. No.81/2006 by Speical Judge MPKVPK Act Shivpuri whereby appellant-Ramveer alias Veera has been convicted as under: :-

I.A.No.10830/2020 2nd repeat u/S. 389(1) Cr.P.C. for suspension of sentence moved on behalf of appellant-Ramveer @ Veera after dismissal of earlier one as withdrawn is taken up and considered.

Appellant has suffered about 14 years of incarceration as against life sentence awarded. Appellant is alleged with single assault.

Learned counsel for the State opposed the application and prayed for its rejection by contending that on the basis of the allegations and the material available on record, no case for suspension of sentence is made out.

Cosidering the above and that there is no likelihood of early disposal of the present appeal in the near future due to ongoing Covid-19 pandemic crises, without entering into merits of the matter, it is directed that appellant be released on interim bail on furnishing bail bond of Rs.50,000/- (Rupees Fifty Thousand Only) with one solvent surety of the like amount to the satisfaction of concerned Magistrate subject to the condition that the appellant shall surrender himself before the concerned Magistrate after expiry of 90 days.

The learned concerned Magistrate and the prosecution are directed to ensure following of Covid-19 precautionary protocol prescribed from time to time by the Supreme Court, the Central Govt. and as well as the State Govt. during release, travel and residence of the appellant during period of suspension of sentence as a consequence of this order.

Let the case be taken up on 4th January, 2021.
