Case diary is not available. Accordingly, the bail application is being decided on the basis of the averments made in the application as well as facts mentioned in the impugned order.
This second repeat application under Section 439 of Cr.P.C. has been filed for grant of bail.
The applicant has been arrested on 27/08/2020 in connection with Crime No.50/2020 registered at Police Station Mahuwa, District Morena for offence under Sections 307, 147, 148, 149 of IPC and Sections 25, 27, 29 and 30 of the Arms Act.
It is submitted by the Counsel for the applicant that according to the prosecution case, when the police party went to arrest the co-accused Gabbar, it is alleged that the applicant alongwith co-accused persons fired at the police party. It is conceded by the Counsel for the applicant, that the applicant is also facing trial for offence under Section 302 of IPC.
Considering the allegations made against the applicant, coupled with the fact that the applicant is also an accused in another offence punishable under Section 302 of IPC, no case is made out for grant of bail to the applicant.
Accordingly, the application fails and is hereby dismissed.
