The accused/applicant seeks interim bail for a period of two months in case FIR No.292/2024 of PS Bhalswa Dairy for offence under Section 21/25/29 of NDPS Act.

The accused/applicant seeks interim bail on the ground that he has to participate in the partition of the property left behind by his father.

At the outset, learned APP for State, assisted by IO/SI Sohan Thakur, points out that earlier also, the accused/applicant filed interim bail application on the same grounds and that application was dismissed as withdrawn before a coordinate bench of this court vide order dated 07.05.2026. That being so, the present application is not even maintainable.

In response, learned counsel for accused/applicant submits that despite order dated 07.05.2026 of the coordinate bench, he was not taken to AIIMS for dental treatment. If that be so, the accused/applicant ought to have filed appropriate proceedings, but fresh interim bail application is not maintainable.

Even otherwise, participation of the accused/applicant in partition of the inherited property is not such a ground on which he deserves interim bail, ignoring the charges against him.

Therefore, the interim bail application is dismissed.
