Judgment
IT is seen from the records and also from the submissions made by the learned Counsels appearing for the complainant and the respondent that quite apart from the complaints being in respect of alleged failure on the part of the respondent-Bank to provide adequate financial assistance to the complainant, which we have repeatedly held to a matter in respect of which no relief can besought from this Commission under Consumer Protection Act, the complainant has also been declared as a sick company and proceedings are in progress before the Board of Industrial and Financial Reconstruction (BIFR) to explore the possibility of settling the scheme for his rehabilitation of his company. Such being the factual situation, we do not feel inclined to conduct any investigation into the merits of this petition and on the said limited ground this petition is closed and will stand disposed of. We express no opinion whatever on the points raised in the pleadings of the parties and nothing contained in this Order will operate to the prejudice of the complainant in the matter of his pursuing other remedies elsewhere. No costs. Petition dismissed.
