Judgment
All the above mentioned bail applications shall stand decided by this common order as they arise out of the same F.I.R.
The present four bail applications have been filed under Section 439 of Cr.P.C. on behalf of the petitioners who are in custody in connection with
F.I.R. No. 54/2020, Police Station Chopasni Housing Board, Jodhpur for the offences under Sections 379, 411 & 413 of I.P.C.
Heard learned counsel for the petitioners and learned Public Prosecutor. Perused the material available on record.
Learned counsel for the petitioners submit that the co-accused Binjaram has already been released on bail by this Court vide Order dated 20.02.2020.
Learned counsels further submit that there is no other case of similar nature pending or decided against the petitioners. They, therefore, pray that the
petitioners may be enlarged on bail.
Learned Public Prosecutor opposes the bail application.
Having regard to the facts and circumstances of the case and upon a consideration of the arguments advanced, this Court is of the opinion that the bail
applications filed by the petitioners deserve to be accepted.
Consequently, the present bail applications filed under Section 439 of Cr.P.C. are allowed. It is ordered that the accused-petitioners (1) Ramniwash
S/o Bhagirath, (2) Kushal S/o Ganpatram, (3) Kishore S/o Dhanji, (4) Ugamchand S/o Mohan Lal and (5) Dinesh Kumar S/o Birbalram arrested in
connection with F.I.R. No. 54/2020, Police Station Chopasni Housing Board, Jodhpur shall be released on bail provided each of them furnishes a
personal bond of Rs.50,000/- (Rupees: Fifty Thousand Only) with two sureties of Rs.25,000/- (Rupees : Twenty Five Thousand Only) each to the
satisfaction of the learned trial court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
