Judgment
Vinit Kumar Mathur, J
The present writ petition has been filed against the order dated 06.12.2014 passed by learned Senior Civil Judge, Sri Ganganagar, whereby the application preferred by the petitioner under Order 6 Rule 17 C.P.C. was rejected.
Learned counsel for the petitioner submits that because of the erection of High Tension Line over the petitioner’s land, the land beneath the High Tension Line is not being used by him at the optimum level. Learned counsel submits that the land which not being appropriately used was not actually acquired by the respondents as only the land where the poles were erected in the petitioner’s field was acquired.
Learned counsel for the petitioner, after having argue the matter at some length, seeks to initiate separate proceedings under the law for getting suitable compensation from the respondents for the non-optimal use of the petitioner’s land which is falling beneath the High Tension Line going over it.
Accordingly, the present writ petition is disposed of with liberty to the petitioner to take appropriate legal remedy available under the law.
Needless to say, the respondents will be having liberty to raise all the just exceptions available under the law.
