By this petition the petitioner has challenged the order dated 26.03.2024 passed by the Tehsildar, Tehsil Petlawad, District Jhabua under the provisions of Section 248 of M.P. Land Revenue Code, 1959.
It is submitted by the learned counsel for the petitioner that immediately in compliance of the said order notice has been issued by the Tehsildar on 01.04.2024 for evicting the petitioner from the disputed property.
In case the same is done he would not be in a position to assail the order dated 26.03.2024 in accordance with law.
In the available facts and circumstances of the case, it is directed that in case the petitioner prefers an appeal against the order dated 26.03.2024 passed by the Tehsildar within a period of 10 days from today along with an application for stay of the order, then till consideration of the stay application of the petitioner by the appellate authority, the order dated 26.03.2024 shall not be given effect to.
With the aforesaid, without expressing any opinion on merits, petition stands disposed off.
