Judgment
This criminal appeal has been filed by the appellant being aggrieved with the order dated 12.04.2019 passed by Special Judge SC/ST Cases, Sri Ganganagar in Criminal Case No. 93/2017 (hereinafter to be referred as 'trial court') whereby, the trial court has rejected the application filed by the appellant under Section 190 CrPC with the prayer for taking cognizance against respondent No.2 along with co-accused Vinod and to summon him.
The trial court after taking into consideration the statements of the witnesses recorded by the police, during the course of investigation and other material filed by the police along with charge-sheet, is of the opinion that prima facie no evidence is available on record to take cognizance against the respondent No.2. The trial court is of the opinion that the complicity of respondent No.2 Dara Singh in commission of crime is not evident from the material available on record, hence the application filed by the appellant is devoid of merit.
Having heard learned counsel for the parties and after going through the perusal of impugned order in which the trial court has discussed every aspects of the matter, I do not find any illegality in the impugned order.
Accordingly, this criminal appeal is dismissed.
