Judgment
The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.135/2021 registered in Police Station
Pratappur, District Surajpur for offence punishable under sections 363, 366, 370, 370-A, 376(3), 120-B, 34 of Indian Penal Code and section 4 and 6 of
the Protection of Children from Sexual Offences Act, 2012.
As per the prosecution case, a report was made by one Ramdani that her daughter went on 2/07/2021 to village hat and has not returned.
Subsequently it was found that she has been taken to Allahabad and was kept in a hotel and she was sexually assaulted. Subsequently she was taken
to Rajasthan as also she was subjected to sexual assault by Dhir Singh after marriage knowing fully well that the victim is a minor.
Learned counsel for the applicant submits that the victim has been examined before the Court and she has not supported the case of the
prosecution, therefore the applicant may be released on bail.
Learned State counsel opposes the prayer for grant of bail.
Victim along with her father appeared through video conferencing from DLSA Surajpur and they did not object to grant of bail.
Considering the statement and no objection to grant of bail by the father and victim, without any further observation on the merit, this court is
inclined to release the applicant on bail.
Accordingly, the bail application is allowed and it is directed that the applicant shall be released on his furnishing personal bond for a sum of
Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for his regular appearance before it as and when directed.
