This is second application u/s 439 of Cr.P.C. The applicant has been arrested in Crime No. 50/2013 registered at Police Station, Jaamner, District Guna, under Sections 304-B & 498-A of IPC. The first application was dismissed by this Court vide order dated 18.6.2013 passed in M. Cr.C. No. 3325/2013.

It is submitted by learned counsel for the applicant that applicant has been falsely implicated. There is no specific allegation against the applicant. Deceased died because she fell into the well. He is in custody since 16.4.2013. Co-accused has already been granted bail by this Court, therefore, on the ground parity applicant prayed for bail. Trial will take some time. Therefore, the applicant be released on bail.

The application is opposed by learned Panel Lawyer. The first application of the applicant has been dismissed by this Court. Taking into consideration the allegations against the applicant as well as the fact that applicant is the husband of the deceased and the deceased died within two years of her marriage under suspicious circumstances and there was allegation of harassment in connection with demand of dowry and after dismissal of the first application no changed circumstances are brought on record, therefore, applicant is not entitled to be released on bail. Consequently, the application stands dismissed.
