Ramesh @ Sattal vs State of Uttarakhand

Applicant- Ramesh @ Sattal, who is in jail in connection with Crime No. 248 of 2011, relating to offence punishable u/s 364 of I.P.C., Police Station Kotwali Gangnahar Rookee, District Hardwar, has sought his release on bail.

Learned counsel for the applicant submitted that the First Information Report is delayed one. It is further submitted that applicant is not named in the First Information Report. It is a case of circumstantial evidence. Learned counsel for the applicant further submitted that co-accused Aakash @ Gola has already been directed to be released on bail by this court on 21.02.2012. It is pleaded that applicant has no criminal history.

In the above circumstances, without expressing any opinion as to final merits of the case, this Court is of the view that the applicant deserves bail.

The Bail Application is allowed. Let the applicant-Ramesh @ Sattal, be released on bail on executing personal bond and furnishing two sureties, each of the like amount, to the satisfaction of Judicial Magistrate, Roorkee. (Urgency Application No. 1051 of 2012 stands disposed of).
