Learned counsels for the petitioners submit that while deciding Writ Petition 762/19 on 9.10.2019, this Court had observed that petitioner therein was petitioner in Writ Petition No. 5963/2015, which was decided on 23.12.2015 and accordingly, orders were passed. They state that similarly, the present petitioners were also petitioners in the columns mentioned in para 7 and 8 of the aforesaid chart.

5.

Respective counsels submit that State has not challenged the orders passed in Writ Petitions mentioned in paragraph 7 and 8. On the contrary, they have submitted that Special Leave Petitions are preferred as per column No.9 before the Hon’ble Apex Court.

6.

Per contra, learned AGP Mr. Pendke submits that since the order is already challenged in SLP, the petitioners cannot take benefit of judgment passed in Writ Petition mentioned in para 7 and 8 of the aforesaid chart.

7.

Learned counsel for petitioners have stated that in all the aforesaid petitions, separate affidavits are filed by the petitioners stating that a challenge raised in respective Special Leave Petitions mentioned in paragraph 9 to the operative clauses of judgments delivered in Writ Petition Nos. 7 to 8, which is reproduced below, will not be pressed before the Hon’ble Apex Court. Operative clause in respective Writ Petitions mentioned in column No. 7 and 8 is reproduced below:

“It is declared that the teachers/professors/lecturers/ candidates, who have not acquired NET/SET/TESE qualification and who are appointed during 24.10.1992 to 30.04.2000 (except 19.9.1991 to 30.10.1992) (see GR dtd. 27.6.2013) are not entitled for CAS (Career Advancement Scheme) and other related benefit except the benefits including the pay scale and increments and other related benefits, as announced by the State, but on condition so reproduced.

8.

The learned counsel for petitioners thus submit that since State has not take exception to the final orders passed in Writ Petitions mentioned in column No. 7 and 8, said benefit can be extended to it.

9.

Considering the fact that the petitioners have filed affidavit before this Court clearly stating that they will not raise challenge to clause stated supra before the Hon’ble Apex Court in respective Special Leave Petitions mentioned in column No. 9 and considering the fact that State has not assailed final order in Writ Petitions mentioned in column no. 7 and 8, we allow all these petitions. The respondent No. 3 is accordingly directed to grant benefit of Career Advancement Scheme to the petitioners in terms of Government Resolution dated 27.6.2013 and grant all the benefits accordingly from the date of appointment, mentioned in clause 5 of the Chart, reproduced above. The entire arrears, if any, be paid to the petitioners within a period of three months from the date of receipt of this order by the respondents.
