I.A. No. 590/2022 is an application for condonation of delay.
No objection is forthcoming.
The fifth Respondent died on 28.10.2020. The Appellant could not take out an application for bringing on record the legal representatives on time and submits that the delay may be condoned in view of the order of the Hon’ble Supreme Court considering the pandemic situation. Even if the entire period to be excluded as directed by the Hon’ble Supreme Court is taken into consideration, there would still be a delay of 99 days or thereabout in filing the application. The Appellant has stated the reasons for the delay it appears to be sufficient and since it is not challenged and no benefit is right by causing the delay the application for condonation of delay is allowed and the application for impleadment is taken on files and allowed.
The amendment shall be carried out within two weeks.
