Judgment

When the matter was last taken up on 27.03.2023, the following order was passed :
“1. Learned counsel for the petitioner submits that the present writ petition is covered by the co-ordinate Bench of this Court dated 16.07.2021 in WPC (OAC) No.2031 of 2015. Copy of the said order has been handed over to the learned Additional Government Advocate for the State.
Learned Additional Government Advocate for the State submits that he may be accommodated to obtain instruction.
As prayed for, list on 10.04.2023.”
In terms of the said order, the learned counsel for the petitioner has served copy of the order dated 16.07.2021 passed in WPC (OAC) No.2031 of 2015. It is agreed at the bar that the writ petition can be disposed of directing the authority to consider the case of the petitioner in terms of the order dated 16.07.2021 passed in similar matter in WPC(OAC) No.2031 of 2015.
Learned Standing Counsel submits that it may also be clarified that if there is any other legal impediment in the matter in consideration of the case of the petitioner.
Accordingly, the writ petition is disposed of directing the authority to reconsider the case of the petitioner in view of the fact that the communication dated 11.03.2015 (Annexure-5) and communication dated 30.04.2015 (Annexure-6) have been already set aside by this Court by an earlier order dated 16.07.2021 passed in WPC (OAC) No.2350 of 2015. The authority shall take a decision in accordance with law as expeditiously as possible preferably within a period of three months from the date of communication of the certified copy of this order along with other documents sought to be relied upon by the petitioner. The decision of the authority shall be communicated to the petitioner within two weeks.
Copy of the order in WPC (OAC) No.2031 of 2015 be kept on record for reference.
