Heard on the stay application.
Counsel for the petitioner submits that respondent No.2 is not legally wedded wife of the petitioner and the respondent No.2 did not reveal the fact about her first marriage to the petitioner and thereby she committed cheating with the present petitioner. Counsel further submits that the respondent No.2 has lodged a completely false and frivolous FIR against the petitioner, therefore, it is prayed that interim protection may be granted to the petitioner.
Learned Public Prosecutor has opposed the prayer for interim protection to the petitioner as in the FIR, specific allegations have been made against him by respondent No.2.
Heard learned counsel for the petitioner and learned Public Prosecutor.
On perusal of the FIR, it appears that the respondent No.2 has levelled specific allegations against the petitioner, therefore no case for grant of interim stay order is made out.
Hence, the stay application is hereby dismissed.
List the misc. petition after two weeks.
