Mr. Samanta, learned advocate appearing for the petitioner submits that the petitioner is a retired employee of the Indian Air Force. After retirement,

his bank account was frozen by CBI. Challenging such action, the petitioner earlier preferred a writ petition being W.P. No.13793 (W) of 2019. The

same was allowed by an order dated 5th September, 2019 and the petitioner was thereafter paid the pension and he continued to receive the same up

to the month of January 2020. Surprisingly, from the month of February 2020 his pension was stopped by the bank authorities on a purported plea that

the pension account has been attached as per the direction of the respondent nos.2 and 3.

Drawing the attention of this Court to the document annexed at page 21 of the writ petition, Mr. Samanta submits that Securities and Exchange Board

of India had already advised the respondent no.5 that the attachment is not to be effected in respect of the petitioner’s bank account

No one appears today on behalf of the respondent nos.4 and 5 and no instruction is forthcoming as to why the petitioner’s pension has been

stopped.

In view thereof, this Court directs the respondent no.5 to file a report before this Court on the returnable date disclosing the reasons as to why the

petitioner has not been paid pension since the month of February, 2020.

List this matter three weeks hence. The petitioner is directed to serve a copy of this order along with a copy of the writ petition upon the respondent

no.5 within a week from date.

It is made clear that in the event no such report is filed, this Court would be constrained to direct personal appearance of the respondent no.5.

The parties are directed to act on a server copy of this order.
