The petitioners have prayed for a direction to the respondents to

consider their case for promotion on the post of Adhyapak (Hindia). It is

contended that the sole reason for not considering the case of the

petitioners for promotion is that the respondents treated them to be

Teachers of Arts Faculty and did not consider them to be teachers of

subject of Hindi. By taking this Court to Annexure-R/1 dated 08.03.2016,

it is submitted that the respondents have realized the said difficulty and

they have decided to convene a DPC for the purpose of examining the

aspect of rectification of Subject in relation to the petitioners. Learned

counsel for the petitioners submits that the respondents may be directed to complete the said exercise within a stipulated time.

Shri Yadav, learned Govt. Advocate submitted his argument on the

basis of reply. By taking this Court to para 4 of the return, it is

submitted that final promotion list was issued on 08.08.2015. The

persons, who are senior to the petitioners, were given promotion.

The petitioners'' entry in the application shows that they belong to

Arts Subject. However, a meeting was convened on 08.03.2016 and

it was held as under:

"VERNACULAR MATTER OMITTED"

Since a decision has already been taken that as per the Degree

of Graduation, the subject of petitioners needs to be corrected and

the matter needs proper consideration, I deem it proper to direct

the respondents to take a final decision about change of subject of

petitioners and about their reconsideration for promotion. The

entire exercise be completed within 90 days from the date of

communication of this order. If the petitioners are found eligible

and fit for promotion, necessary promotion orders be passed within

aforesaid time. If they decide otherwise, a reasoned order be

passed and communicated to the petitioners.

Petition is disposed of without expressing any view on the merits

of the case.
