Judgment

The petitioner has filed the present petition under Article 226 of the Constitution of India challenging the notice dated 02.06.2023 issued by respondent No.4, building Officer, Zone – 3, Ujjain Municipal Corporation directing the petitioner to vacate the land acquired for widening of the road within three days.
Learned counsel for the petitioner submits that the petitioner is in possession of the land for the last many years and the aforesaid notice is contrary to the notification dated 26.05.2023 passed by the Government under Section 19(4) of M.P. Nagar Tatha Gram Nivesh Adhiniyam, 1973.
After hearing learned counsel for the petitioner and upon perusal of the impugned order, it is evident that aforesaid order has been passed in the form of notice to vacate the land. The petitioner is granted liberty to file reply / objection raising all the issues to the impugned notice within seven days and respondent No.4 shall consider and decide the objection of the petitioner in accordance with law by passing a reasoned and speaking order within one month thereafter.
Till the objection of the petitioner is decided, the petitioner shall not be evicted from the land in question.
With the aforesaid, Writ Petition stands disposed of.
