Judgment
S.K. Gangele, J.—Heard. The petitioner has filed this petition against the order 01-11-2012 (Annexure P-1) and the order dated 12th April, 2007 (Annexure P-2).
The Tahsildar passed an order of settlement in favour of the petitioner on 02-10-1984. Subsequently, it was found that the petitioner was not eligible for settlement because in the khasra entries of year 1985-1986 her possession was recorded. Earlier her possession was not recorded. The petitioner did not produce the evidence in regard to her possession over the land for more than one year. Hence, the matter was taken in review with a permission of the competent authority and order of settlement was set aside. Against the aforesaid order, the petitioner filed a revision before the Additional Commissioner, that has been dismissed. Thereafter, a revision was filed before the Board of Revenue, that has also been dismissed. Against the said order, a review petition was filed and that has also been dismissed.
From the aforesaid facts of the case, it is clear that the petitioner failed to submit proof in regard to her possession over the land except for a period of one year. In such circumstances, in my opinion, the authority has rightly cancelled the settlement order which was passed earlier in favour of the petitioner. There is no illegality or irregularity in the orders impugned. Consequently, I do not find any merit in this writ petition. It is hereby dismissed. No order as to costs.
