Judgment
Petitioner has approached this Court praying for issuance of a writ of mandamus directing the respondents to invite the petitioner and other candidates belonging to the General Category for 2nd counselling at par with SC/BC, Ex-Servicemen candidates for the post of Supervisor.
It is the contention of counsel for the petitioner that 33 posts belonging to the General Category were advertised for being filled up of Supervisor. The 1st counselling was held in 2016 and thereafter, no further process was taken. Now in the year 2020, 2nd counselling is being held from 29.01.2020, wherein only the Scheduled Castes, Backward Class, Ex-Servicemen Category candidates are being called for counselling, whereas the General Category candidates are not being called for such counselling. He, thus, contends that direction is required to be issued to the respondents to call the General Category candidates also for the 2nd counselling as the reserved category candidates have been called for.
This contention of learned counsel for the petitioner cannot be accepted as it is a discretion of the appointing authority to fill up the posts from the source as required and in any case, it is only a process of selection as of now, which has not yet been finalized and, therefore, petitioner has no right as yet having been crystalized. The discrimination as is alleged to have been made is not made out as of now because it is for the appointing authority to adopt its own procedure for filling up the posts and from which category and at what time, such discretion lies with them. The prayer, therefore, as made in the present writ petition, at this stage, cannot be accepted.
The writ petition, therefore, stands dismissed.
