Judgment

The short grievance of the Petitioner regardless of the pleadings is, essentially, as to rate of sale price being lesser than what he is otherwise entitled to. Learned counsel for the Petitioner draws attention of the Court to the proceedings drawn by the Deputy Commissioner which arguably supports his contention.
Learned AGA on request appearing for the Respondents opposes the Petition contending that in similar matters of the kind, this Court has already taken the view that no relief can be granted since it is a matter of sale, i.e., contract between the parties as contemplated under Section 54 of the Transfer of Property Act, 1882 and ordinarily in matters of private contract indulgence of Writ Court is not warranted. This Court is in complete agreement with submission made by the learned AGA.
In view of the above, this Writ Petition being thoroughly devoid of merits is liable to be dismissed and accordingly it is, costs having been made easy.
