The petitioner is an officer in the Sarva U.P. Gramin Bank and is posted at Jhansi. The petitioner is aggrieved by the order dated 29.11.2008 passed by the Kshettriya Vikas Prabandhak in which it is stated that a decision has been taken to transfer the petitioner and he has been called upon to report at the head quarters. Counsel for the petitioner submitted that the bank has framed a transfer policy wherein it has been provided that in case of a spouse of an employee being in government service his request for a place of posting at a nearby place shall be considered by the bank. Counsel for the petitioner submitted that the petitioner''s wife is posted at Jhansi and the petitioner has no objection in case he is posted in a nearby branch. Counsel for the petitioner states that the petitioner has not yet been relieved from his posting at Jhansi. It is stated that the petitioner has already filed a representation dated 1.12.2008 in this regard to the Chairman of the Bank respondent no.1 but the said representation has not yet been disposed of.

We have heard Sri Dharmendra Vaishya, learned counsel for the bank.

In view of the fact that the representation of the petitioner is pending it is appropriate that the same may be disposed of by the respondent no.1 expeditiously and preferably within a period of three weeks from the date a copy of the representation along with a certified copy of this order is filed by the petitioner before him. In case the petitioner files before the respondent no. 1 a copy of this order along with a copy of the representation within a period of one week from today the operation of the order dated 29.11.2008 shall remain stayed provided the petitioner has not yet been relieved from his present posting at Jhansi. With the above observations the writ petition is disposed of.

Let a certified copy of this order be made available to the counsel for the parties within 24 hours on payment of usual charges.
