On 08.08.2023, this Court had granted interim bail to the petitioner for assessing the age of the petitioner.

The learned counsel for the petitioner submitted that as per the order of this Court, the petitioner has not produced the sureties, since he was arrested in some other case and has judicial custody, on the day of this order.

The learned Additional Public Prosecutor appearing for the respondent police submitted that now, the examination result has been received, wherein it was found that the petitioner is aged about 18 years.

The learned counsel for the petitioner repeatedly stated that the petitioner is a juvenile. But, the medical examination result does not support of his case.

Since the petitioner was arrested and remanded to judicial custody in some other case, the interim bail granted to the petitioner in Crime No.2005 of 2022 has now become infructuous, at this time. Therefore, he can move the bail application before the trial Court in Crime No.104 of 2022 on the file of the Ampathurai Police Station, Dindigul District and inform the Court about the development on 18.09.2023

Let the copy of the medical examination result be served to the learned counsel for the petitioner, so that, he can workout his remedy through the appropriate proceedings, if he is aggrieved over the result. Another copy is also be served to the petitioner through the Superintendent of Prison, Central Prison, Trichy.
