Petitioner had been working as Beldar in Paonta Sahib Sub Division, though at different stations since 1989. Initially, he was appointed on daily wages and in 2001, his services were regularized and he was appointed in regular pay scale. Now, after more than 20 years, he has been shifted to adjoining Sub Division, Shillai. He is aggrieved by this transfer effected vide order, Annexure P-2, which is dated 28th May, 2011.

His contention is that only five months before issuing of impugned order, Annexure P-2, he had been shifted from Bunga Timbi to Khara. Both these places were within the same Sub Division, i.e. Paonta Sahib Sub Division, in which Sub Division, Petitioner had been working for more than 20 years. Now, he has been shifted to a different Sub Division by Superintending Engineer vide impugned order. Earlier order was issued by the Assistant Engineer and it was, in fact, not a transfer order, but only temporary deployment till further orders.

In view of the fact that earlier order was only temporary deployment and not the transfer order and also the fact that the Petitioner had been working in the same Sub Division for more than 20 years, I see no merit in the writ petition. Hence, the same is dismissed.
