Hon’ble Pankaj Purohit, J.

By means of the present writ petition, the petitioner has challenged the communication dated 17.01.2025 issued by the Directorate General, Assam Rifles, Pension/NE Record Branch, whereby a sum of ₹12,167/- was released towards Battle Injury Lump Sum Compensation. The petitioner claims that, in view of his 40% permanent disability arising out of a gunshot injury sustained during Operation “ORCHID” on 14.02.1994 and his recognition as a Battle Casualty, he is entitled to ₹8,00,000/- under the Office Memorandum dated 07.06.2017, leaving a balance of ₹7,87,833/-.

Learned counsel for the petitioner submits that the petitioner may be permitted to submit a detailed representation before the competent authority for consideration of his claim in accordance with the applicable policy and relevant records.

Learned counsel for the State has no objection to the said prayer.

Heard learned counsel for the petitioner and learned counsel for the State and perused the material available on record.

In view of the submissions made by learned Counsel for the parties, the writ petition is disposed of with liberty to the petitioner to move a detailed representation before the competent authority within three weeks from the date of receipt of a certified copy of this order, along with all relevant documents in support of his claim.

In case such a representation is filed within the aforesaid period, the competent authority shall consider and decide the same strictly in accordance with law, the applicable government policy and the relevant records, by means of a reasoned and speaking order, within a period of three months from the date of receipt of the representation.
