Judgment
Dr. Pushpendra Singh Bhati, J
Learned counsel for the appellant submits that the witnesses have consistently not named the present appellant. Learned counsel further submits that the allegation is upon one Bhanwar Singh and the independent eye-witnesses in their statements have not named the present appellant.
Learned counsel also submits that during investigation, the investigating officer did not find any case to be made out against the present appellant.
Learned Public Prosecutor opposes the submissions.
After hearing learned counsel for the parties and perusing the material available on record, this Court is of the opinion that at the stage of cognizance even if there is a strong suspicion then also the cognizance can be taken. The statements of Bakhtawar
Singh, Ladu Singh, Aasu Singh and Mangu Singh have mentioned the name of the present appellant.
In view of the above, the present appeal is dismissed with liberty to the appellant to take up all his issues at appropriate stage. All pending applications stand disposed of.
