In view of the reasons mentioned in the application, the same is allowed and the hearing of the main petition is preponed from 15.2.2024 and is taken on board today.
CWP-30064-2022 (Main Case)
The petitioners seek issuance of a writ in the nature of mandamus so as to direct the official respondents to step up their pay so as to bring the same at par with private respondents No.5 to 17, who are stated to be juniors to the petitioners.
Learned counsel representing the petitioners submitted that although the petitioners served a legal notice dated 26.5.2022 (Annexure P-8), but to no avail.
Notice of motion.
On the asking of the Court, Mr. Aman Dhir, DAG, Punjab, who is present in Court, accepts notice on behalf of respondent - State and has submitted that the claim of petitioners shall be considered in accordance with rules and legal precedents.
Having regard to the fact that legal notice dated 26.5.2022 (Annexure P-8) has not been decided so far, this Court does not feel it necessary to call for any response of the respondents. Without commenting anything as regards merits of the case, the instant petition is disposed of with a direction to the official respondents to consider and dispose of the legal notice dated 26.5.2022 (Annexure P-8) in accordance with law expeditiously preferably within a period of 4 months from today. In case, it is found that the petitioners are entitled to some dues, the same shall be paid within a period of 2 months thereafter.
