The applicant has filed this application under Section 482 of CrPC for deletion/modification of condition no.8 imposed by Coordinate Bench of this Court [ Hon'ble Shri Justice Anand Pathak] vide order dated 07-02-2020 passed in MCRC No.5620 of 2020.
It is submitted by learned counsel for the applicant that while this Court granting bail to the applicant has imposed condition no.8 with a direction to the applicant to appear before the Police Station concerned on every Monday at between 10:30 am to 12:00 pm till the filing of charge sheet and applicant is an old person aged 66 years and is regularly appearing before the police station concerned since 2020. It is further submitted that charge sheet has not yet been filed. Therefore, considering the age of the applicant, condition no.8 may kindly be deleted.
Considering the age of the applicant, this application filed under Section 482 of CrPC is hereby allowed. Condition No.8 imposed byCoordinate Bench of this Court vide order dated 07-02-2020 passed in MCRC No. 5620 of 2020 stands deleted.
MCRC stands disposed of accordingly.
Let a copy of this order be sent to the concerned trial Court as well as police station concerned for information and compliance.
