The petitioner has prayed for setting aside the transfer order on the ground that he is a Booth Level Officer (B.L.O.). By placing reliance on Annexure P-3, the petitioner submits that he is B.L.O.. Recently, this Court has decided a batch of petition which will govern the case of the petitioner as well. Accordingly, this petition is disposed of in terms of the order passed by this Court in W.P. No. 5004/2012 (Devendra Jain Vs. State of Madhya Pradesh and others) decided on 27.07.2012.
Considering the aforesaid, I deem it proper to direct the petitioner to prefer the representation with relevant circular within seven days before the competent authority along with certified copy of this order, failing which interim protection shall not be available to the petitioner. In turn, the said authority shall consider and decide the representation by a reasoned order expeditiously.
Till decision of the representation, the effect and operation of impugned order Annexure P-1 shall remain stayed. With the aforesaid, petition stands disposed of. Certified copy as per rules.
