Judgment
Jaswant Singh, J.—Prayer u/s 438 Cr.PC is for grant of anticipatory bail in case FIR No. 301 dated 16.9.2010 under Sections 323, 302, 148, 149, 34 IPC, PS Sadar Jind.
As per allegations in the FIR lodged by Badan Singh eye witness, Petitioners armed with lathis alongwith their co-accused reached the spot of occurrence on hearing the altercation between Krishan and deceased Sunehra. There was a background of a dispute between son of the Krishan and son of Sunehra on earlier day. On raising of lalkara by Krishan, Petitioners alongwith co-accused armed with lathis are alleged to have caused injuries on the deceased and the complainant resulting into the death of Sunehra.
Learned Counsel submits that from the allegations made in the FIR it is clear that no role has been attributed to the Petitioners Ram Rattan and Jai Bhagwan and therefore, prayer is for grant of anticipatory bail.
After hearing the learned Counsel, I find no ground to entertain the plea raised. It is evident that the Petitioners alongwith co-accused had formed an unlawful assembly and armed with deadly weapons had reached the spot with a common object. No ground for grant of anticipatory bail is made out.
