Judgment
M. Katju, J.—This petition has been filed for quashing the impugned orders dated 1994 and 15994 (annexure8 and 10 to the writ petition) and for a mandamus directing the respondents to decide the claim of the petitioner for grant of selection grade.
I have heard learned Counsel for the parties.
The petitioner was initially appointed as a constable in the U.P. Police in 1958 and in 1964 he was promoted as Head Constable. Thereafter he was promoted as SubInspector and then Inspector. He has claimed selection grade for which he has made a representation dated 19994 vide Annexure11 to the writ petition.
A counteraffidavit has been filed in which it is admitted in paragraph8 that the petitioner was promoted as a Inspector on 121083 and he would have been given selection grade on 121093 on completing ten years as a Inspector, but he was given adverse entries from 6792 to 131292 and from 1193 to 7793 and hence he cannot be given selection grade because his work was not satisfactory. In paragraph9 of the counteraffidavit it is stated that adverse entries were given to the petitioner in the year 199293 against which the petitioner made a representation which was rejected by the D.I.G. In the rejoinder affidavit it has been stated that the petitioner''s service was confirmed on 16494 and hence earlier entries were washed off and now the petitioner is entitled to selection grade.
In my opinion, the petitioner should now make a representation to the authority concerned for grant of selection grade and the said authority shall decide the same within two months of the production of the certified copy of this order in accordance with law.
With these observation, this petition is finally disposed of.
