Heard learned counsel for the petitioner, learned Standing Counsel for opposite party nos.1 and 2 and Sri Ibrahim Abbas, holding brief of Sri Puneet Chandra, learned counsel for opposite party no.3.
Notice need not be sent to opposite party no.4 in view of the order which the Court proposes to pass.
The contention of the petitioner is that despite order passed by the opposite party no.2 on 06.10.2007 (Annexure No.3 to the writ petition) directing the opposite party no.4 to make payment to the petitioner his one day salary illegally deducted by him for extraneous reasons and considerations, the opposite party no.4 is not complying with the said order. A prayer has been made that the opposite party no.2 may be directed to proceed against the opposite party no.4 for noncompliance of his order dated 06.10.2007 in accordance with law.
Learned counsel for the opposite parties have not objection to the grant of prayer made by the petitioner.
In view of the aforesaid, the writ petition is finally disposed of with a direction to the opposite party no.2 to take appropriate action against the opposite party no.4 in accordance with law, in case the opposite party no.4 has not complied with his order dated 06.10.2007, within a period of one month from the date of production of certified copy of this order.
