Ram Pratap vs State of Rajasthan and Others

Vineet Kothari, J.—The petitioner herein has claimed promotion from the post of Constable to the post of Head Constable in the respondent-Police Department.

The learned counsel for the petitioner during the course of arguments submitted that during the pendency of the writ petition, upon an application under the Right to Information Act, 2005, the petitioner was supplied the copy of marksheet for the written examination held for said promotion. Upon receiving the marksheet, he has come to know that marking in the written test is proper. However, for the interview and other out-door test etc., the marks have not been properly awarded by the respondents.

The learned counsel for the respondents submitted that the petitioner failed to secure minimum marks and the mark-sheets produced by the petitioner clearly shows that the petitioner could not succeed in the said examinations for promotion to the post of Head Constable. The learned counsel for the respondents also pointed out that in similar circumstances, the writ petition of one Rati Ram bearing SBCWP No. 10590/2013 - Rati Ram V/s State and ors. has been dismissed by this Court on 25.4.2014 on the ground that the petitioner failed to secure minimum marks. However, the learned counsel for the petitioner still pressed the present writ petition.

In the circumstances of the case, the present writ petition is disposed of with a direction and liberty to the petitioner to file a suitable representation to the respondent-Inspector General of Police, Jaipur, who is expected to decide the said representation expeditiously and preferably after giving an opportunity of hearing to the petitioner within a period of three months from today. No order as to costs. A copy of this order be sent to the parties concerned forthwith.
