Learned counsel for the petitioner Mr. Ankit Sinha is present.

Learned counsel for the petitioner has sought adjournment by stating that this case has to be argued by Mr. Peeyush Krishna Choudhary and he is not in town. However, in the order dated 21.10.2022, it has been recorded that the matter has been posted today upon the submissions made by learned counsel Mr. Peeyush Krishna Choudhary.
The counsel appearing today before this court has placed the foundational facts and it appears that as per the charge, an amount of Rs. 1,250 was recovered from A.K. Jha, who was on duty along with the petitioner and further an amount of Rs. 120 was also recovered from the place of occurrence found wrapped in a paper. The charge sheet was issued to the petitioner and the petitioner had denied the charges. Thereafter the petitioner was subjected to disciplinary proceedings where he had duly participated. Enquiry report was also forwarded to the petitioner to which he responded. The enquiry report is not on record, but it appears from the final order that the seizure list was also prepared on the spot and thus apparently it is neither a case of no evidence against the petitioner, nor it is a case of violation of principles of natural justice, nor there appears any violation of statutory rules. The petitioner had filed appeal against the order of punishment which was dismissed against which the revision has also been dismissed.
Since the counsel appearing today has sought adjournment on the ground of absence of arguing counsel Mr. Peeyush Krishna Choudhary, matter is adjourned and directed to be posted on 21.11.2022 to be taken up at 2.15 P.M. as the first case.
Let this matter be treated as part heard.
