Petitioner approaches this Court seeking issuance of a writ of Habeas Corpus for issuance of a direction for getting his wife released who was alleged to be illegally confined by respondent No.5-father of petitioner’s wife.
Pursuant to a direction having been issued by this Court on 06.02.2024, the learned State counsel has filed status report by way of affidavit of Mr.Jagdish Kalia, Deputy Superintendent of Police, Tohana, Fatehabad, wherein he has deposed that the SHO concerned made the necessary inquiry and recorded the statement of the petitioner’s wife Neha Rani and also of her father i.e. respondent No.5-Des Raj in the police station and also before the Legal Aid Counsel wherein both of them consistently stated that Neha Rani was residing with her father out of her free will and wished to stay with her father.
Faced with the aforesaid position, learned counsel for the petitioner submits that he may be permitted to withdraw this writ petition with liberty to avail of other alternate efficacious remedies as may be available to him in case any grievance still survived.
Dismissed as withdrawn with the liberty as prayed for.
