The petitioner has assailed his transfer from Government Primary School Jangi to Government Primary School Shiyasho ordered by the respondents on 17.07.2023. Both schools fall under Education Block, Pooh, District Kinnaur.
The respondents have placed on record a copy of instructions dated 27.07.2023 issued from the Director Elementary Education. In terms of these instructions, the petitioner was appointed as Junior Basic Trained Teacher at Government Centre Primary School Liyo, District Kinnaur, where he remained posted from 01.03.2014 to 26.05.2016. The petitioner, thereafter, was transferred to Government Centre Primary School Akpa Khas, District Kinnaur. He remained posted there from 27.05.2016 to 14.03.2023. On account of zero enrollment in Government Centre Primary School Akpa Khas, the petitioner was temporarily deputed to Government Primary School Jangi, District Kinnaur. Government Centre Primary School Akpa Khas was de-notified on 12.07.2023. The Government issued a notification on 12.07.2023 directing adjustment of staff from de- notified schools to single teacher/without teacher, school. It is in this manner, the petitioner was adjusted in Government Primary School Shiyaso, District Kinnaur, single teacher school, against vacancy. The respondents have also indicated in the instructions that at Government Primary School Jangi, District Kinnaur, two teachers are already working against the created posts.
Faced with the above factual position, learned counsel for the petitioner submitted that he may permitted to withdraw this petition as the petitioner intends to move representation to his employer/respondents seeking his suitable adjustment.
In view of above, this writ petition is disposed of as withdrawn with liberty reserved to the petitioner to move representation to his employer/respondents seeking suitable adjustment. Pending miscellaneous application(s), if any, shall also stand disposed of.
