Petitioner has been elected as Director of a Primary Cooperative Society. Now, a Chairman of the said Society has to be elected and District Magistrate, Hairdwar has notified the election vide order dated 10.09.2021. The polling was to be done on 28.09.2021, however, now the election has been postponed on an apprehension of riot.
Under Rule 440 of Uttarakhand Co-operative Societies Rule, 2004, election can be postponed, however, next date of election has to be notified.
Since the election has been postponed, therefore, the Competent Authority is required to notify the date of election, in terms of Rule 440 of Uttarakhand Co-operative Societies Rule, 2004.
In such view of the matter, the writ petition is disposed of with a direction to District Magistrate, Haridwar to notify fresh date of election as early as possible; but, not later than fifteen days from the date of production of certified copy of this order.
Let a certified copy of this order be issued today itself.
