RSA No. 151 of 2008
Mr. Ashok Sud, learned Senior Counsel appearing for the appellant submits that in terms of his instructions, the suit land now stands purchased by the appellant from the respondent/ plaintiff and therefore, in this view of the matter, as the appeal has been rendered infructuous, he has instructions to withdraw the same.
The appeal is accordingly dismissed as withdrawn, in view of the statement so made by learned Senior Counsel appearing for the appellant. Pending miscellaneous application(s), if any, also stand disposed of accordingly.

Mr. Romesh Verma, learned Senior Counsel appearing for the appellant submits that he is not aware as to whether the suit land stands purchased by the private respondent or not.
Be that as it may, in view of the fact that RSA No. 151 of 2008 has been withdrawn by the appellant therein on the ground that the suit land has been purchased by him from the respondent, this Court has no reason to disbelieve the statement made by learned Senior Counsel in RSA No. 151 of 2008. In this view of the matter, the present appeal is also ordered to be closed. Pending miscellaneous application(s), if any, also stand disposed of accordingly.
