I.A. No. 1589 of 2026:

Heard Ld. Counsel for the Appellant, Ld. Counsel for Intervenors, Shri Rajeev Jain has also appeared for Amicus Curiae.

Shri Nakul Dewan, Ld. Sr. Counsel appearing for the IRP has pointed out to the court an order of the Hon’ble Supreme Court passed on 10.04.2026 in Civil Appeal No. 2626 of 2025. He has placed reliance on the various paragraphs of the order. Shri Rajeev Jain submits that the matter is pending before the Hon’ble Supreme Court and listed on Monday i.e. 20.04.2026.

We are of the view that the clear intendment of the paragraph 5 order is that all projects whether fully completed, substantially or partially completed, or which are lying incomplete and inactive including those which have been handed over to NBCC shall be determined by a common authority that may be set up by the Supreme Court. In view of above order, all applications which are pending with respect to different projects which are partially complete or lying incomplete and inactive and to be handed over to the NBCC, it is as per the order of the Hon’ble Supreme Court that the committee shall take appropriate call on the said issue and we are of the view that no separate consideration is required in pending application. The pending applications are disposed of with liberty to seek relief before the Court appointed Committee.

Coming to the I.A. No. 1589 of 2026, Ld. Counsel for the Applicant submits that the said I.A. only relates to prayer for registration of documents with respect to project which has already been completed. In view of the order of this Tribunal passed on 25.09.2024 and 16.10.2024, this project was already separated and directed to be completed in view of the agreement between the parties, which exclusion of the project has also been noticed by the Hon’ble Supreme Court in its order dated 05.02.2026 in Civil Appeal No. 2626 of 2025.

Shri Nakul Dewan, Ld. Sr. Counsel in I.A. No. 1589 of 2026 submits that letter dated 15.03.2026 was written by the IRP. Shri Rajeev Jain, Ld. Counsel for the Amicus Curie seeks time to obtain instructions. We permit Ld. Amicus Curiae to look into that application and obtain instructions.
