Judgment
Adarsh Kumar Goel, J.—This petition was filed against order dated 4.5.1991 passed by Superintendent Central Jail, Ambala imposing punishment as a result of order holding that the petitioner was guilty of dereliction of duty while working as a convict night watchman as a result of which Surinder Singh another prisoner attempted to commit suicide by tying a rope round his neck.
It is contended that no enquiry as such was held. Reply has been filed stating that punishment was imposed as per procedure being followed which included judicial appraisal by District and Sessions Judge. Learned counsel for the petitioner submitted that since right of the petitioner was taken away without giving opportunity to the petitioner, he is entitled to compensation.
Having regard to the facts and circumstance of the case, I do not find any illegality in view of punishment having been imposed after due procedure and after due approval by the District and Sessions Judge.
Dismissed.
