Judgment
Mahesh Grover, J.—The petitioner has now been promoted with effect from the date his juniors were promoted. The consequential benefits have, however, not been released to him and it has been stated by the learned counsel for the respondent that the needful will be done positively within a period of four weeks from today. Earlier, this Court had noticed that the inaction on the part of the respondents was unjustified and the stand unreasonable. An affidavit has been filed indicating the names of the officers who are guilty of inaction and failed to pass an order on the pretext of flimsy excuse. The names of these officers have been extracted herein-below:-
i) Sh. Sohinderjeet Singh, Superintending Engineer/OP Circle PSPCL, Roop Nagar has rejected the claim of the petitioner by passing speaking order dated 22.05.2009 (Annexure P-5).
ii) Parkash Singh, Under Secretary Personnel has passed the order promoting the juniors of the petitioner vide office Order No. 202 Zone D dated 23.10.2006.
iii) Narinder Kaur, Superintendent Grade-II, Zone D and Surinder Kumar, Senior Assistant, Zone D have prepared list of promotion to the Juniors of the petitioner.
iv) Sh. Major Singh, Senior Executive Engineer, PSPCL, Anandpur Sahib, Roopnagar have signed and filed the written statement in this case.
I have considered the contents of the affidavit and have noticed that an apology has been tendered for the delay caused in granting the relief to the petitioner. The Court, therefore, disposes of the petition as having become infructuous with a direction already noticed above for the release of consequential benefits to the petitioner but before parting with the order, the aforesaid officers are warned to be careful in future. This warning be recorded in their service books.
