This appeal is preferred against the order passed by the learned Single Judge in WP(C) No. 1209/2004 on 25.5.2004 This is a case which requires no interference as the learned single Judge has found from the enquiry papers that the appellant confessed about his guilt by giving complete details.
The charge sheet has also been perused. From a perusal of the chash sheet it appears that there was defalcation of huge amount to the tune of Rs. 4 crores. Even at the stage of enquiry, according to the learned single Judge, on perusal of the record, it is clear that adequate opportunity was given to appellant to defend himself at the enquiry.
We find no reason to interfere in the appeal. Hence, the appeal is dismissed. In the facts and circumstances of this case, the delay of 52 days cannot be condoned as it is not satisfactorily explained, though we have considered the matter on merits. CM No. 1451/2005 being the stay application is also rejected.
