Judgment
Tarlok Singh Chauhan, J
Mr. Chander Prakash, Assistant Engineer, HPPWD, Sub-Division, Rampur is present in person and states that the Department has no objection to
construct the road provided that the residents of the area through whose land the road is to be constructed execute gift deed(s) in favour of the
Department as required under Law.
Learned counsel for the petitioner, after obtaining instructions, states that the residents of the area are ready to execute the gift deed and would do
the needful within two weeks from today. Her statement is taken on record.
In this view of the matter, the writ petition is disposed of by directing the residents of the area, who shall be persuaded by the petitioner, to execute
the necessary gift deed as expeditiously as possible and preferably within two weeks.
Since the residents of the area have already undertaken to execute the necessary gift deed, therefore, we direct the respondents to commence the
construction work of the road immediately and complete the same as expeditiously as possible and in no event later than 31.08.2021.
The petition is disposed of accordingly, so also pending application, if any. Parties are left to bear their own costs.
For compliance to come up on 7th September, 2021.
